FOCUS FUSION – TRAINER TERMS & CONDITIONS (OFFICIAL)
1. Introduction
These Terms & Conditions (“Terms”) govern your use of the Focus Fusion Trainer Platform (“Platform”). By registering as a trainer and using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.
2. Role of the Trainer
You operate as an independent fitness professional.
You acknowledge that:
- You are not an employee, agent, or partner of Focus Fusion
- You are solely responsible for your coaching, advice, and services
- You are responsible for all interactions with your clients
Focus Fusion provides a technology platform only and does not deliver training services itself.
3. Account Registration & Verification
You must:
- Provide accurate and complete information
- Maintain up-to-date profile details
- Complete identity verification (KYC) where required
- Maintain the confidentiality of your login credentials
You are responsible for all activity under your account.
4. Trainer Profile & Content
You are responsible for all content uploaded to the Platform, including:
- Profile information
- Training materials (PDFs, videos, notes)
- Messages and communications
You confirm that:
- You have the right to use and share all uploaded materials
- Your content does not infringe any third-party rights
- Your content is accurate and appropriate for fitness coaching.
5. AI Avatar & Training Data
You consent to the creation of an AI avatar trained on your materials. You acknowledge that:
- The AI avatar reflects your coaching style and methodology
- You are responsible for the materials used to train the AI
- The AI may communicate with clients on your behalf
You must:
- Ensure uploaded materials are appropriate and safe
- Monitor AI performance where necessary
- Take over conversations when appropriate
Focus Fusion does not guarantee accuracy of AI outputs.
6. Client Relationship & Conduct
You agree to:
- Communicate professionally with clients
- Provide safe and appropriate coaching advice
- Respond to client queries in a timely manner
- Maintain appropriate boundaries
You must not:
- Engage in abusive or inappropriate behaviour
- Provide medical diagnoses unless qualified
- Mislead clients regarding qualifications or outcomes.
7. Bookings & Session Delivery
You are responsible for:
- Managing your availability
- Delivering booked sessions
- Ensuring session quality
You must honour confirmed bookings unless cancelled in accordance with your policy. Repeated failure to deliver sessions may result in suspension.
8. Pricing & Payments
You set your own pricing for services.
Payments:
- Are processed via third-party providers (e.g., Stripe, PayPal)
- May include platform fees deducted automatically
You acknowledge:
- Focus Fusion is not responsible for payment provider issues
- Payout timelines depend on third-party providers.
9. Cancellations & Refunds
You are responsible for setting and communicating your cancellation and refund policies.
You must:
- Apply policies consistently
- Handle client issues professionally
Focus Fusion may intervene in disputes where necessary but is not obligated to do so.
10. Platform Fees
Focus Fusion may charge platform or booking fees. These may:
- Be added to user payments
- Be deducted from trainer earnings
Fee structures may change with notice.
11. Compliance & Legal Obligations
You must:
- Comply with all applicable laws and regulations
- Hold appropriate certifications and insurance where required
- Ensure your services are safe and lawful
You are solely responsible for regulatory compliance in your jurisdiction.
12. Data & Privacy
You agree that:
- Client interactions may be monitored for quality and safety
- Data may be used to improve AI and platform performance
You must:
- Handle client data responsibly
- Not misuse or export client data outside the Platform without consent.
13. Intellectual Property
You retain ownership of your training materials. By uploading content, you grant Focus Fusion a licence to:
- Use the content to train AI avatars
- Display and process the content within the Platform
You may not copy or misuse other trainers’ materials.
14. Acceptable Use
You must not:
- Attempt to bypass the Platform for payments
- Solicit clients outside the Platform to avoid fees
- Interfere with system functionality
- Upload harmful or illegal content.
15. Suspension & Termination
Focus Fusion may suspend or terminate your account if:
- You breach these Terms
- You engage in misconduct
- You provide unsafe or inappropriate coaching
You may stop using the Platform at any time.
16. Limitation of Liability
To the maximum extent permitted by law:
- Focus Fusion is not liable for client outcomes
- Focus Fusion is not liable for indirect or consequential losses
- Liability is limited to amounts paid through the Platform.
17. Changes to the Platform
Focus Fusion may update or modify the Platform, including:
- Features
- AI functionality
- Fee structures
Continued use constitutes acceptance of changes.
18. General
These Terms form the entire agreement between you and Focus Fusion. If any provision is invalid, the remainder remains in effect. These Terms may be updated periodically.
