Welcome to Focus Fusion. By accessing or using our services, you agree to be bound by these Terms and Conditions. Please read them carefully before proceeding. If you do not agree with any part of these terms, you may not use our services.

1. Introduction

Welcome to Focus Fusion. These Terms & Conditions (“Terms”) govern your use of the Focus Fusion platform, including the mobile application, website, and any related services (the “Platform”).
By creating an account, accessing, or using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you should not use the Platform.

2. What Focus Fusion Does

Focus Fusion is a technology platform designed to connect users with personal trainers and enhance that relationship through AI-supported coaching tools.
The Platform provides:

  • Access to personal trainers and their AI avatars
  • Messaging via in-app chat and WhatsApp integration
  • Session booking and payment functionality
  • Workout guidance, logging, and progress tracking
  • Notifications, reminders, and motivational prompts

Focus Fusion facilitates and enhances the trainer–client relationship but does not replace it.

3. User Accounts

To access the Platform, you must create an account and provide accurate, current, and complete information.
You agree to:

  • Keep your login credentials secure
  • Not share your account with others
  • Notify us of any unauthorised access

You must be at least 18 years old, or have parental/guardian consent where permitted. You are responsible for all activity under your account.

4. Trainer Relationship

Users may be linked to a personal trainer via a unique trainer code.
Your trainer:

  • Operates independently of Focus Fusion
  • Sets their own pricing and services
  • Is responsible for the coaching provided

Focus Fusion does not guarantee results or outcomes. You may change or delink your trainer at any time within the Platform.

5. AI Avatar & Messaging

The Platform includes AI-powered trainer avatars trained on materials provided by the trainer.
These AI avatars:

  • Reflect the trainer’s coaching style and approach
  • May respond when the trainer is unavailable
  • May escalate conversations to the trainer where appropriate

AI responses are provided for general guidance only. They are not medical advice, diagnosis, or treatment. You should consult a qualified professional where appropriate.

7. Bookings & Payments

Users may book training sessions through the Platform.
Key terms:

  • Bookings are confirmed only upon successful payment
  • Payments are processed via third-party providers (e.g., Stripe, PayPal)
  • Trainers set pricing for their sessions
  • Cancellation, rescheduling, and refund policies may apply

Failure to attend a session may result in loss of payment depending on the trainer’s policy.

8. Subscriptions

Some features may be offered via subscription plans.
If you subscribe:

  • Your subscription may renew automatically unless cancelled
  • You can manage or cancel via your account settings
  • Access to premium features ends upon cancellation

Refunds for subscriptions are not guaranteed unless required by law.

9. Platform Fees

Focus Fusion may charge a small platform or booking fee per transaction.
This fee supports the provision and ongoing development of the Platform and is included within your total payment.

10. Acceptable Use

You agree not to:

  • Use the Platform for unlawful or harmful purposes
  • Send abusive, offensive, or inappropriate messages
  • Attempt to disrupt or hack the Platform
  • Provide false or misleading information

Focus Fusion reserves the right to suspend or terminate accounts that violate these Terms.

11. Data & Privacy

We collect and process personal data to provide and improve the Platform.
This may include:

  • Account and profile information
  • Workout and activity data
  • Messages and communications
  • Payment and transaction data

Conversations may be monitored for quality, safety, and system improvement purposes. Full details are outlined in our Privacy Policy.

12. Availability of Service

We aim to provide a reliable and high-quality service, but we do not guarantee:

  • Continuous or uninterrupted availability
  • Error-free operation
  • Immediate response times

Features, including AI functionality and integrations (such as WhatsApp), may evolve or change over time.

13. Limitation of Liability

To the maximum extent permitted by law:

  • Focus Fusion is not liable for indirect, incidental, or consequential losses
  • We do not guarantee fitness results or outcomes
  • Our liability is limited to the amount paid by you through the Platform

Nothing in these Terms excludes liability where it cannot be excluded by law.

14. Changes to the Platform

We may update, modify, or enhance the Platform and its features at any time.
Where appropriate, we will notify users of significant changes. Continued use of the Platform constitutes acceptance of those changes.

15. Termination

We may suspend or terminate your account if:

  • You breach these Terms
  • You misuse the Platform

You may stop using the Platform at any time. Certain provisions will survive termination, including liability and data provisions.

16. General

These Terms constitute the entire agreement between you and Focus Fusion. If any provision is found to be invalid or unenforceable, the remaining provisions will continue in full effect. These Terms may be updated periodically, and the latest version will always apply.
